AMRAK (Europe) Limited referred to as “AMRAK” throughout this document is committed to protecting the privacy of our customers, business partners and employees. Throughout our business dealings and in the provision of our services we are required to collect and use certain personal data. This is mainly to assist in the administration of an insurance contract or a claim. Any data we collect will be stored securely and used for the purpose it was intended. Any data or information we obtain shall be used in accordance with this privacy statement.
In some cases, the data we receive will be provided to us by a third party or an insurance agent. This might be a solicitor, insurance broker or other agent acting on your behalf. They will have their own privacy policy and will have obtained your consent prior to disclosing such information to us. Each agent or third party should be able to provide you with information about how they use your personal data.

Data Controller

For the Purposes off the (GDPR) Data Protection Act 2018 (DPA 2018) which came into force on 25th May 2018, AMRAK shall be considered to be a Data Controller. Amrak (Europe) Limited is recorded on the Data Protection Register under registration number ZA317210. What is personal Data?

Personal Data is information that relates to an identified or identifiable individual. This is not limited to a name and address but can include any information whether electronic or otherwise that could be used to identify an individual as well as information regarding that individual.

I am a Policyholder

If you are a policyholder we will require certain information to fulfil the preparation of an insurance contract, handling a claim or dealing with a complaint. The information we obtain shall include your name and address and any sensitive information regarding you, or the legal dispute you are involved with. On some occasions it might also be necessary to obtain and process copies of medical records. In addition, we also have regulatory obligations to comply with including but not limited to detecting and reporting financial crime, money laundering, and fraud.

How will we use the information you give us?

We will use your information on the basis that it is necessary to administer your insurance contract or help you make a claim. Where we need to pass information to other firms, it will only be for that purpose. These firms will be Insurers, other insurance brokers, price comparison sites and firms handling claims. It includes finance providers and firms that process or administer our records.

When we contact you, it will either be for the above reason, or because we have a legitimate interest in marketing related products. For any other marketing it will only be with your consent and you will be able to withdraw your consent or unsubscribe easily at any time.

If we have to transfer information to a third country outside the EU, we will only do so if a similar level of protection applies. If we need to obtain information which is by nature sensitive, we will only do so on the basis that it is in the public interest – for example to fight crime, prevent fraud or to make sure insurance is available.

What type of personal information do we collect?

We may need personal details which might include your name, address, date of birth any any information confirming your identity. We might also collect details of your legal dispute, members of your family, lifestyle, finances, business or education.

We will only collect what is necessary and will only keep it for as long as we are required to do in line with our data retention policy.

What other types of information do we need?

Under certain circumstances we may also need to obtain information about Race or Origin, Gender, Religion, Health, Politics, Genetics, Trade Union Membership, Sex or Sexual Orientation.

We might also need details of criminal convictions, previous insurance claims and legal disputes.

We will only collect what is necessary and protect it with appropriate security measures.

How do we obtain your information?

We may gather information from information submitted via an agent, broker, solicitor, website, by telephone, face to face or by email or in writing.

We may receive it and share it with insurers, other insurance brokers, introducers, agents, price comparison sites and firms handling claims. This might include finance providers and firms that process or store our records.

What are my legal rights

You have the right to complain to the Information Commissioner at http://www.ico.org.uk, Tel 0303 123 11132.

You can obtain a copy of your personal information from us without charge by contacting us at the address above. This may include the right to transfer information to other providers.

You have the right to ask us to correct information.

You have the right to ask us to delete your information or stop using it, unless it is necessary for us to retain it for insurance or financial purposes as set out in our document retention policy.

You may have the right to object if decisions about you are made solely by a computer.

I am a Business Partner

Whilst providing our services we may require personal data. Personal data is information about you from which you can be identified such as your name and contact details. Information about you might be collected because of a business relationship between you or your employer and us. Such information shall be stored securely and used for correspondence and marketing purposes. If you are a customer, we are required to store information for regulatory and compliance purposes.

 You have the right to object to your personal data being processed for a legitimate interest such as direct marketing or for statistical analysis.
